ENGLISH VILLA TURQUEZA LLC PHOTO SESSION AGREEMENT & LIABILITY WAIVER

By entering Villa Turqueza LLC, I acknowledge and agree to the following terms and conditions on behalf of myself and anyone attending with me:

1. ENTRY & GUEST POLICY

This reservation includes access for the person being photographed and approved photography staff only, unless otherwise authorized by Villa Turqueza LLC.

Any additional family member, friend, or guest entering the property to accompany or participate in the session will be charged $25.00 per person, regardless of whether they stay for part of the session or the entire session, whether they are included in photos or not, and whether they are participating in family portraits or simply accompanying the client.

All guests must be disclosed upon arrival.

2. CHILDREN POLICY

For safety reasons, children under 12 years old must remain under adult supervision at all times while on the property.

If children are left unattended, running freely, entering restricted areas, or creating unsafe conditions, Villa Turqueza LLC reserves the right to ask the client and/or guests to leave the property immediately without refund.

3. POND / WATER / WATERFALL AREA

The pond, waterfall, and surrounding water areas are restricted. Only the person being photographed is allowed to enter the pond or water area for photo purposes.

No additional family members, friends, children, or guests are permitted in or around the water unless specifically approved by Villa Turqueza LLC.

Villa Turqueza LLC is not responsible for accidents, slips, falls, injuries, damaged clothing, damaged equipment, or any incidents related to the use of the pond, waterfall, wet surfaces, decks, rocks, or surrounding natural areas.

Wet decks, rocks, and surrounding surfaces may be slippery and are entered at the client’s and photographer’s own risk.

4. STUDIO / SET RULES

Indoor studios, staged sets, and interior photography areas are to be treated with care and respect. The following rules apply:

  • No food or drinks inside indoor studio areas
  • No shoes in designated interior set areas
  • Only authorized persons may enter restricted spaces
  • Clients and guests are responsible for any damage caused to furniture, props, walls, décor, flooring, swings, decks, or equipment

Any damage caused during the reservation may result in additional charges for repair or replacement.

5. USE OF SETS / CONDUCT POLICY

All photography sets, props, swings, decks, and staged areas are intended exclusively for the person being photographed.

  • Family members, friends, or guests are not allowed to use any sets for personal photos.
  • Swings, props, and decorative elements are not to be used for play or recreational purposes.
  • Swings are decorative props only and may only be used under the direction of the photographer during the session.

Any misuse of sets, props, swings, or installations may result in immediate termination of the session without refund and/or additional charges for damages.

6. NO SMOKING / NO ALCOHOL POLICY

To maintain the quality, safety, and environment of Villa Turqueza LLC:

  • Smoking is strictly prohibited anywhere on the property during your photo session.
  • Alcohol consumption is not permitted during your stay for the photo session.

Failure to comply with this policy may result in removal from the property without refund.

7. PRIVATE PROPERTY / ASSUMPTION OF RISK

Villa Turqueza LLC is a private property with outdoor natural terrain, uneven ground, water features, landscaping, decks, steps, decorative structures, and staged photo areas that may involve inherent risks.

By entering the property, I understand and voluntarily assume all risks associated with being on the premises and participating in a photo session, including but not limited to:

  • slips or falls
  • wet or uneven surfaces
  • insect bites
  • weather conditions
  • pond and water-related areas
  • decks and platforms
  • swings
  • decorative sets
  • staged furniture
  • props
  • elevated or unstable surfaces
  • and any indoor or outdoor areas being used as part of the photo session

I understand that all sets, structures, swings, decks, and decorative installations used for photography are entered and used at my own risk.

Villa Turqueza LLC is not responsible for any accidents, injuries, damaged clothing, damaged equipment, or personal/property loss resulting from the use of these areas.

8. LIABILITY RELEASE

I hereby release, waive, and discharge Villa Turqueza LLC, Maria Velasco, its owners, staff, representatives, and affiliates from any and all claims, demands, damages, losses, liabilities, costs, or expenses arising from:

  • personal injury
  • property damage
  • loss or theft of personal belongings
  • vehicle damage
  • accidents
  • or any incident occurring while on the property

This release applies to myself and all guests, family members, children, photographers, makeup artists, assistants, or any person entering under my reservation.

9. CLIENT RESPONSIBILITY

The client signing this agreement is fully responsible for:

  • all guests entering under their reservation
  • ensuring their group follows Villa Turqueza rules
  • supervising children at all times
  • and informing all attendees of these policies before arrival

10. RIGHT TO REFUSE / REMOVE

Villa Turqueza LLC reserves the right to deny entry or ask any individual or group to leave the property immediately if rules are not followed, if unsafe behavior occurs, or if staff determines the environment is being disrupted or compromised.

No refund will be issued in cases involving rule violations, unsafe conduct, or failure to comply with property policies.

11. WEATHER / RAIN POLICY

In the event of rain, it will be up to the photographer’s professional judgment whether to pause and wait for the rain to stop in order to continue the session.

If the rain continues for more than one (1) hour and the session cannot reasonably continue, the session may be rescheduled at the discretion of Villa Turqueza LLC and based on the availability of:

  • Villa Turqueza LLC
  • the photographer / studio
  • and the client

Rescheduled sessions will be coordinated according to the next mutually available date.

Villa Turqueza LLC is not responsible for weather-related interruptions, delays, lighting changes, muddy conditions, wet surfaces, or other natural outdoor conditions caused by rain or weather.

Weather-related interruptions do not automatically qualify for refunds or time extensions.

12. AGREEMENT

By signing below, I confirm that I have read, understood, and agreed to all terms and conditions stated above.

I also understand that I am signing on behalf of myself and anyone entering Villa Turqueza LLC under my reservation.
